1. RIGHT TO RECEIVE A GOOD FAITH ESTIMATE OF EXPECTED CHARGES
Under the No Surprises Act
You have the right to receive a “Good Faith Estimate” explaining how much your medical care will cost. Under the federal law, health care providers need to give individuals meeting at least one of the below qualifying circumstances an estimate of the bill for medical items and services.
As of January 1, 2022, these No Surprises Act requirements applied to items and services provided to most individuals enrolled in private or commercial health coverage, like:
- Employment-based group health plans (both self-insured and fully insured)
- Individual or group health coverage on or outside the Federal or State-based Exchanges
- Federal Employee Health Benefit (FEHB) health plans
- Non-federal governmental plans sponsored by state and local government employers
- Certain church plans within IRS jurisdiction
- Student health insurance coverage [as defined at 45 CFR 147.145]
These requirements don't apply to people with coverage through programs like Medicare, Medicaid, Indian Health Services, Veterans Affairs Health Care, or TRICARE. These programs have other protections against high medical bills.
If you are an individual meeting one of the above qualifying circumstances, you have the right:
- To receive a Good Faith Estimate for the total expected cost of any non-emergency items or services. This includes related costs like medical tests, prescription drugs, equipment, and hospital fees;
- Make sure your health care provider gives you a Good Faith Estimate in writing at least one business day before your medical service or item. You can also ask your health care provider, and any other provider you choose, for a Good Faith Estimate before you schedule an item or service;
- To dispute a bill issued to you of at least $400 more than your Good Faith Estimate; and
- To receive a copy of your Good Faith Estimate.
